Data Privacy • KVKK • Brand Protection
Product origin verification systems play a critical role in combating counterfeiting while also creating new responsibilities for personal data security. Under KVKK, Türkiye’s Personal Data Protection Law, brands must process customer data collected during verification in a minimal, anonymous and secure manner.

1. Data Flows in Product Verification Systems
When a customer scans a product’s QR or NFC code, the system may collect:
- 📍 Geographic location: based on IP or GPS
- 📱 Device type and browser information
- ⏱️ Timestamp
- 🧾 Verification result: genuine / counterfeit / suspicious
Although not every item individually constitutes personal data under KVKK, combining them can make an individual identifiable. The guiding principle should therefore be data minimisation.
“Verification should be secure, but should not become a means of tracking the user.”
2. Fundamental Principles Under KVKK
| Principle | Description | Implementation |
|---|---|---|
| Data minimisation | No more data than necessary should be collected | Location should be processed only at country/region level |
| Anonymisation | Personal data is de-identified | IP addresses should be stored as hashes |
| Explicit consent | The user’s informed approval | Display consent wording on the verification page |
| Data security | Prevent unauthorised access | Data transmission over SSL/TLS 1.3 |
3. Anonymising Customer Data
- IP Hashing: Anonymising IP addresses with SHA-256 makes retrospective identification impossible.
- UUID Tokenization: Each verification session receives a random identity, without association with a real user.
- Data Lifecycle Management: All verification logs are automatically deleted after 30 days or moved to an anonymous archive.
4. Balancing KVKK and Brand Protection
Brands generally want to collect more data to improve product security. Under KVKK, however, this may be considered excessive processing. The right balance is:
- 🔍 The minimum data necessary for verification
- 📉 Anonymous reporting that does not identify individuals
- 📜 Transparent privacy notices
“Protecting data is an extension of protecting reputation.”
5. Data Processing Policy: A Transparency Standard
Core KVKK information to include in verification systems:
- Data controller and contact information
- Processing purpose: “Product verification and counterfeit detection”
- Data retention period and destruction policy
- International transfers: for example, CDNs or global verification APIs
- User rights: access, rectification, erasure, etc.
6. International Data Transfer Risks
Verification systems generally run on global infrastructure such as Cloudflare, AWS or Google Cloud, creating a risk of international data transfers. In these cases:
- Transferred data should be anonymised,
- Data processing agreements (DPAs) and EU Standard Contractual Clauses (SCCs) should be followed,
- Explicit consent or safe-country criteria compliant with Article 9 of KVKK should be satisfied.
7. Automated Compliance Auditing
- AI Audit: Analyses KVKK logs to detect unnecessary data fields.
- Consent Tracker: Stores users’ consent preferences by version.
- Data Purge Scheduler: Automatically deletes personal data at the end of the specified period.
“Data privacy is the invisible side of brand security.”
