What’s in this article?

The fact that Cookie banner appears on the screen alone does not necessarily mean proper cookie management. Banner design should allow the user to make real choice, and technical behavior in the background should be consistent with that preference.

As of 2026, the basic principle of good cookie consent design is not to push the user to the "accept" option, but to offer a clear and genuine preference.

What Does Cookie Banner Legally Try to Solve?

The legal process to be applied when processing personal data with cookies or similar tracking technologies is evaluated based on the purpose and nature of the technology used.

Not all cookies require explicit consent, but where consent is required, its validity conditions must be met.

Guide on KVKK Cookie Applications

The Personal Data Protection Agency's Guide to Cookie Practices of July 2025 is an important application reference for websites in Turkey.

Accept / Reject / Preferences

The KVKK guide recommends equally presenting these buttons in the cookie panel:

  • Accept,
  • Reject,
  • preferences

Presenting these choices equally is good practice.

Colour, size or font size nudging users only toward acceptance can compromise freely given consent.

Opt-In Principle

It is not right to run cookies based on explicit consent before the user makes an active choice.

For cookies requiring consent, the KVKK guide emphasises opt-in as the required approach.

Using the Site Is Not Consent

The approach "By continuing to use this site, you are deemed to have accepted all cookies" does not meet the active explicit consent requirement.

The user must be able to make a real and active choice.

Compulsory Cookies

Strictly necessary technical cookies must be distinguished from analytics and advertising cookies.

For example:

  • session,
  • security,
  • Basket

Such technical functions depend on the specific use case.

Is Analytics Cookies Automatically Required?

Oh, no. The fact that a measurement tool is useful for business does not automatically make it "absolutely necessary" for service.

Legal basis and technical use must be analyzed concretely.

Granular Preference

The user should not be forced to choose "all or none" alone.

If different purposes such as function, analysis, and advertising are required, it should be evaluated to present category-based selection to the user.

Cookie privacy notice

The KVKK guide calls for understandable information about each cookie’s:

  • Name,
  • purpose,
  • Duration,
  • First-party or third-party status

It is important to provide understandable information about it.

Privacy Information and Explicit Consent Are Separate

Privacy information fulfils the duty to explain processing; explicit consent, when needed, is a separate legal act.

With the KVKK's Principle Resolution 2026/347, it has been emphasized again that privacy information and explicit consent processes should not be confused.

Withdrawing Consent Must Be Easy

The banner must not appear once and then vanish so users cannot change their preferences.

The KVKK guide considers a small administrative icon or similar mechanism to be an example of good practice, which is permanent but does not block content, so that consent can be freely withdrawn.

Valid Consent under GDPR

EDPB Guidelines 05/2020 require freely given, specific, informed and unambiguous consent.

The pre-marked box or inactivity of the user does not constitute valid consent.

Cookie Banner Taskforce

The EDPB Cookie Banner Taskforce report revealed common problem areas faced by supervisory authorities in Europe in cookie banner practices.

Among them:

  • The visibility of the possibility of rejection,
  • pre-selected options,
  • misleading design,
  • Cookie placement without consent

These are common problem areas.

Dark Pattern Risk

The user interface should not manipulate legal selection.

For example:

  • Making the acceptance button too big and bright,
  • Hiding the refusal option into the link,
  • making it difficult to refuse with an unnecessary number of clicks,
  • Using misleading text

It can pose a risk in terms of free will.

Does CMP Really Block Cookie?

One of the most common technical problems is that although banner seems to be correct, analytics or ad scripts work ahead of consent.

In compliance control, not only the screenshot but also the network request and tag behavior must be tested.

Google Consent Mode Is Not a Legal Basis Alone

Consent Mode is a technical signal and measurement infrastructure. It should also be considered which legal basis is valid and which cookie can work.

Cookie Banner Technical Test List

  • Which cookies appear on initial page load?
  • Does analytics run before consent?
  • Do advertising tags stop after rejection?
  • Is the change of preference technically enforced?
  • Does the third-party iframe or SDK send data?
  • Is there a Consent record?

Cookie Banner UX and Compliance Checklist

  • Accept and reject options balanced?
  • Is Opt-in being implemented?
  • Do non-essential trackers run before consent?
  • Is there a category-based selection?
  • Is the privacy information clear?
  • Is the cookie name, purpose, and duration specified?
  • Is withdrawing consent easy?
  • Is Dark pattern used?
  • Does true script behavior match CMP?
  • Are privacy information and explicit consent separate?

The B10 Approach

B 10 Digital Agency checks more than banner wording: CMP, tag manager, analytics, ad scripts, network behaviour and legal text are assessed together.

Official reference framework

This guide was updated on the basis of the Guideline on KVKK Cookie Applications, KVKK's Principle Resolution 2026/347, EDPB Guidelines 05/2020 and EDPB Cookie Banner Taskforce report.

Conclusion

Cookie banner's legal quality cannot be considered separate from its design. The system that does not give the user real preference or employs a tracker prior to consent is not a real consent management system, no matter how professional it appears on the screen.
