A common startup mistake is treating a copied online privacy policy as KVKK compliance. An accurate policy or privacy notice requires knowing what personal data the company actually processes, why and how.
Data management and privacy are an operating model, not a document: inventory, purpose, legal basis, retention, access, security, suppliers and user rights must be managed together.
First Data Map, Then Text
Map personal data flows before writing the privacy document.
At least the following questions should be answered:
- What personal data is being collected?
- For what purposes is it processed?
- In what systems is it kept?
- Who has access?
- With which suppliers is data shared?
- Is there a transfer abroad?
- How long is data retained?
1. Set Data Categories
Data processed according to Startup's business model may vary.
For example:
- ID and contact information,
- account information,
- Order or transaction records,
- requests for support,
- device and log data,
- marketing preferences,
- employee and candidate data.
2. Document the Purpose of Each Processing Activity
Very broad statements, such as "developing our services", may not be enough for actual data management.
For example, distinguish these purposes for contact details:
- account creation,
- order notifications,
- Support,
- security,
- marketing.
These purposes must be kept distinct.
3. explicit consent Is Not the Default Basis of Every Processing
The terms of personal data processing under the KVKK must be evaluated on a concrete process basis. It is not the right design to automatically link each data processing activity to explicit consent.
The duty to inform and explicit consent are separate processes.
4. The privacy notice Should Tell the True Process
The privacy notice should be in line with what the company actually does.
The text should not include the system that the company does not use or the transfer it does not make; in reality, critical transactions must not be skipped.
5. Distinguish a Privacy Policy from a KVKK Privacy Notice
In global products, "Privacy Policy" may be a broader privacy document. The content and presentation requirements of the KVKK duty to inform in Turkey should also be evaluated.
It should not be assumed that a single global text automatically meets all country obligations.
6. Data Minimization
At the MVP stage, collecting unnecessary data “just in case” increases technical and legal risk.
For each form field, the question should be asked:
Is this data really necessary to perform this process?
7. Set Storage Time
Keeping personal data indefinitely is not the right data management approach.
Set retention and deletion policies by data category, considering:
- business purpose,
- legal obligation,
- limitation periods or dispute-related needs,
- technical requirements.
These considerations guide the policies.
8. Access Permissions
Not all employees need to see all customer data.
Role-based access allows different access levels for:
- customer service,
- Finance,
- marketing,
- Technical team,
- management.
Each role can have its own access level.
9. Inventory SaaS Suppliers
Startup data may not be available on its server alone.
CRM, analytics, email, cloud, support, payment, project management, and AI services can process personal data.
For each supplier, review:
- What data he accessed,
- For what purpose is it used,
- where data is processed,
- contractual terms.
These require assessment.
10. Overseas Data Transfer
The presence of Cloud or SaaS service abroad may also require evaluation in terms of personal data transfer.
Under the current foreign transfer regime of the KVKK, the appropriate transfer mechanism must be specified in the specific process.
11. Cookies and Tracking
Analytics, advertising, heatmap, or remarketing tools are part of the website privacy structure.
The purpose of which cookie or technology is used must be determined; the mechanism presented to the user must be consistent with actual technical behavior.
12. Commercial Electronic Messages
Personal data processing and commercial electronic messaging are separate legal processes. Email and SMS marketing require a separate assessment of relevant messaging obligations.
13. Security Controls
Even if the privacy text is strong, if the data security is poor, true compliance will not be achieved.
Minimum technical controls may include:
- MFA,
- Strong access policy,
- encryption,
- logging,
- backups,
- patch management,
- incident response.
These are possible controls.
14. Data Breach Procedure
The incident response flow must be determined before a personal data breach occurs.
Questions must be answered in advance who will conduct technical analysis, who will conduct legal evaluation, and who will coordinate relevant notifications.
15. Data Subject Requests
The channel where users can communicate their requests for their personal data must be defined.
It takes an operational process to register applications, inform relevant teams, and track legal deadlines.
16. Recheck Data Flow if You Are Using AI
Employees or the product sending customer data to AI services may create a new data flow.
Therefore, also assess:
- Which model is used,
- Which data was sent,
- How data is processed by the provider,
- retention and transfer conditions.
These need separate evaluation.
Startup Data Management Checklist
- Is there a data inventory?
- Is processing objectives defined?
- Are the privacy notice compatible with the actual process?
- Unnecessary data fields removed?
- Do they have a retention period?
- Are permissions role-based?
- Are SaaS providers in inventory?
- Are foreign transfers evaluated?
- Is the cookie and tracking structure in the document?
- Is there a data breach procedure?
- Is there a process for data subject requests?
- Is the data going to AI services known?
Proposed Structure for Privacy Document
A user-facing document based on the actual processing activities may generally include:
- identity of the data controller,
- processed data categories,
- processing purposes,
- legal basis or conditions of processing,
- data recipients and transfer purposes,
- method of data collection,
- data subject rights and the request channel.
Base these sections on the actual data inventory, rather than using a copy-and-paste template.
The B10 Approach
The B10 Digital Agency does not treat KVKK compliance as producing only policy text. It configures data flows, systems, SaaS services, access powers, overseas transfers and technical security controls together.

Conclusion
The starting point for privacy compliance for startup is not a long policy text, but the correct data map. A privacy document prepared without knowing what data is collected, who accesses it, where it is kept, and when it will be deleted does not represent the actual operation.
This content is for general informational purposes. Concrete KVKK/GDPR obligations should also be assessed according to the company's business model, data flows and applicable legislation.
