KVKK & data security audits

KVKK audits are a measure of digital trust, not just a legal obligation. Yet poor process management leaves companies exposed to substantial administrative fines through recurring mistakes in their procedures.

Summary: As of 2025, the Turkish Data Protection Authority examines technical controls as well as retention policies, anonymisation processes and the transparency of cookie records.

1. Failing to keep the data inventory current

A common mistake is failing to update the processing inventory even once a year. When a system, form or third party is added, not revising the inventory is treated as an audit nonconformity.

“An inventory is a living document, not a one-off task.”

2. Confusing privacy notices with explicit consent

A privacy notice informs; explicit consent requires an affirmative choice. Combining the two texts is among the violations frequently reported by the Authority.

“The notice informs; consent authorises.”

3. Missing or outdated cookie policies

With the new Consent Mode V2 era, cookie policies need technical and textual updates. Missing cookie types, providers, durations or purposes undermine the information given to users.

4. Lack of Contract in Sharing Data with Third Parties

With service agencies, cloud services and software providers, a data processing agreement (DPA) is needed; its absence makes transfers legally risky.

5. Failing to keep logs

Without logs showing who accessed which data and when, system security lacks traceability. Audits treat that gap as a serious finding.

“Trust is built on traceability.”

6. Lack of Continuous Staff Training

KVKK training is not a one-time process. In particular, sales, customer service, and IT teams need to receive up-to-date legislation training at least once a year.

7. Using deletion instead of anonymisation

Deleting data is not the same as anonymising it. The Authority requires the process to be irreversible.

8. Omitting camera recordings from privacy notices

Businesses often overlook that camera recordings also fall within KVKK. These data require a privacy notice and security policy to be prepared.

9. Missing approval for cross-border transfers

If cloud-based systems (e.g. Google, Meta, HubSpot) are used, the foreign transfer clause must also be specified in explicit consent texts.

"Even cloud, cross-border transmission cannot be without permission."

10. Delayed data breach notification

Pursuant to Article 12/5 of the KVKK, data breaches must be reported to the Institution and to the persons involved within 72 hours. Delay leads to both fines and loss of reputation.
