KVKK Compliance in Influencer and Remarketing Campaigns: An Implementation Guide

Social media campaigns bring responsibilities for data processing as well as brand visibility. KVKK compliance is an integral part of influencer partnerships, remarketing and user consent management.

Summary: Every ad click involves data processing. KVKK compliance matters for both legal obligations and brand reputation.

1. Data sharing in influencer partnerships

Influencer campaigns can involve personal data shared between brands and content creators. Follower interactions, giveaway forms and information received through direct messages are treated as personal data.

  • In the agreement with the influencer, responsibility for data processing must be clearly stated.
  • Data must be used for campaign purposes only and deleted at the end of the campaign.
  • In giveaway or form-based campaigns, users must be able to view the privacy notice.
  • In this campaign arrangement, the brand is the controller and the influencer or agency is the processor.

“Manage data sharing as carefully as influencer posts.”

2. Reflect user consent in advertising platforms

Platforms such as Meta, TikTok, LinkedIn and Google Ads respond to consent signals. Campaign data processing requires consent settings and advertising systems to stay synchronised.

  • Activate the Meta Consent Mode and TikTok Privacy Mode integrations.
  • Use only data from users who have given explicit consent for advertising targeting.
  • Through Google Tag Manager, pass the consent parameter signal to advertising conversion tags.
  • When a user withdraws consent under the KVKK, remarketing lists must be updated automatically.

“Advertising platforms must reflect consent; silence is not consent.”

3. Personal data and commercial messages: distinct obligations

The Commercial Communications Legislation (Law No. 6563) with the KVKK must be evaluated together. The message, e-mail, or DM sent to the user creates two different obligations, both as data processing and as commercial messages.

  • No commercial content can be sent to recipients without a message management system (IYS) record.
  • If the data collected is to be used only for communication purposes, explicit consent must also be obtained.
  • Keep consent boxes for personal data processing and commercial communications separate.
  • Limit retention to the campaign period and anonymise the data afterwards.
B10 recommendation: Legal and media teams should manage campaign compliance together. Publishing without a compliance check exposes the brand to substantial fine risks.

4. B10 Digital Agency compliance model

B10 uses its B10 KVKK Compliance Model to make campaign data processing transparent:

  • Definition of data liability in Influencer contracts,
  • DPA for campaign data (Data Processing Contract),
  • Consent notices in giveaway and form-based campaigns,
  • Advertising platform–CMP (Consent Management Platform) synchronisation,
  • Data deletion and anonymisation checklist.

“Launching a campaign is easy; KVKK compliance reflects responsible brand management.”
